Castel Code ("Castel Code," "the Company," "we," "us," or "our") is a registered software company based in Lusaka, Zambia, providing mobile app development, web development, AI/ML solutions, robotics and automation, and technology consulting services. These Terms & Conditions ("Terms") apply to visitors of our website at castelcode.tech and to all clients who engage us for project work.
By browsing this website, submitting an inquiry, or signing a proposal or contract with us, you agree to be bound by these Terms. If you do not agree, please discontinue use of the website and our services.
02 Definitions
- "Client" means any individual, business, or organization that engages Castel Code for a paid project or consultation.
- "Deliverables" means the software, applications, designs, documentation, or other materials produced by Castel Code for a Client under an agreed scope of work.
- "Services" means all mobile app, web, AI/ML, robotics/automation, and consulting work offered by Castel Code.
- "Website" means castelcode.tech and any subdomains operated by Castel Code.
03 Our Services
Castel Code offers custom software development across the following areas:
- Mobile application development (Android/Kotlin, cross-platform)
- Web development and hosting-ready platforms
- Artificial intelligence and machine learning solutions
- Robotics and automation systems
- Technical consulting and advisory services
Specific project scope, timelines, and deliverables are agreed separately in a written proposal, quote, or contract for each engagement. Nothing on this website constitutes a binding offer until a scope of work is signed by both parties.
04 Accounts & Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to enter into a service agreement with Castel Code. Where our website or products require an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
05 Quotes, Payments & Billing
Project quotes provided by Castel Code are estimates based on the information available at the time and may be revised if project scope changes. Unless otherwise agreed in writing:
- A deposit may be required before work begins.
- Remaining balances are due according to the milestones set out in the project proposal.
- Late payments may result in a pause of active work until accounts are settled.
- Prices are quoted in Zambian Kwacha (ZMW) or US Dollars (USD) as specified in the proposal.
06 Intellectual Property
Unless otherwise agreed in writing, all pre-existing tools, frameworks, code libraries, and methodologies used by Castel Code remain the intellectual property of Castel Code. Upon full payment, ownership of the final, custom-built Deliverables specific to the Client's project transfers to the Client, excluding any third-party components, open-source libraries, or Castel Code's proprietary internal tooling, which remain licensed rather than sold.
All content on this website — including the Castel Code name, logo, brand marks, graphics, and text — is the property of Castel Code and may not be copied, reproduced, or reused without written permission.
07 Client Content & Confidentiality
Any materials, data, or information a Client shares with Castel Code for the purpose of a project will be treated as confidential and used solely to deliver the agreed Services. Castel Code will not disclose Client confidential information to third parties except where required to complete the project (e.g. third-party APIs the Client has approved) or where required by law.
Where a signed Non-Disclosure Agreement (NDA) is in place for a specific engagement, its terms take precedence over this section.
08 Acceptable Use
When using our website or Services, you agree not to:
- Use our Services for any unlawful purpose or to build software intended to cause harm;
- Attempt to gain unauthorized access to Castel Code systems, code repositories, or client data;
- Reverse-engineer, resell, or redistribute Castel Code proprietary tools without permission;
- Submit false or misleading information when requesting a quote or consultation.
09 Third-Party Services
Our projects may integrate third-party platforms such as Firebase, Google Maps, payment gateways, or cloud hosting providers. Use of these platforms is subject to their own terms and privacy policies, and Castel Code is not responsible for outages, pricing changes, or policy changes made by these third parties.
10 Warranties & Disclaimers
Castel Code will perform Services with reasonable skill and care consistent with industry standards. However, our website and general information are provided "as is," and we do not guarantee that software will be entirely free of bugs, uninterrupted, or fit for every possible use case beyond the agreed project scope.
11 Limitation of Liability
To the fullest extent permitted by law, Castel Code's total liability for any claim arising from our Services is limited to the amount paid by the Client for the specific project giving rise to the claim. Castel Code is not liable for indirect, incidental, or consequential damages, including loss of profits or data, except where such liability cannot be excluded by law.
12 Termination
Either party may terminate a project agreement with written notice as specified in the individual contract. In the event of termination, the Client is responsible for payment of all work completed up to the termination date.
13 Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Zambia. Any disputes arising from these Terms or from a Castel Code service agreement shall be subject to the exclusive jurisdiction of the courts of Zambia.
14 Changes to These Terms
Castel Code may update these Terms from time to time to reflect changes in our Services or legal requirements. Updated Terms will be posted on this page with a revised "Last updated" date. Continued use of our website or Services after changes are posted constitutes acceptance of the revised Terms.
